ATLANTA ? An attorney for a graduate school counseling student told federal judges in Atlanta on Tuesday that the student’s First Amendment rights were violated when professors at a Georgia university sought to punish her for her biblical views on gay rights.

Augusta State University put Jennifer Keeton on academic probation for saying it would be hard for her to work with gay clients, and threatened to expel her unless she attended events like Augusta’s gay pride parade, Keeton’s attorney Jeff Shafer told the 11th U.S. Circuit Court of Appeals.

“She was told, `You don’t have to believe it. You just have to say you do,’” Shafer said.

Augusta State University countered that the counseling program would risk its accreditation if it didn’t hold Keeton to a code of ethics. The school has a duty to require students to counsel all segments of the community, including those who are gay or transgender, it said in court papers.

Keeton told other students that she was interested in practicing conversion therapy ? where a therapist tries to “cure” a person from being homosexual ? after graduation, said Cristina Correia with the state Attorney General’s office. Correia said Keeton also told her professors she would tell any clients who said they were gay that homosexuality is morally wrong.

University faculty were concerned that Keeton was scheduled to practice counseling in middle and high schools as part of her degree program and could possibly harm young students with her views, Correia said.

“The university has a responsibility when putting students in a practicum and graduating them,” Correia said. “When you have that kind of evidence, the faculty could not, under their ethical standards, put that student in a clinical setting without further remediation.”

Keeton, who said she’s a devout Christian “committed to the truth of the Bible,” enrolled in the school’s counselor education program in fall 2009 and soon began discussing her views that sexual behavior is a personal choice and that gender identity isn’t subject to change.

Faculty members were alarmed after she wrote in a term paper that it would be hard with her to work with gay clients. The school told her that her language was unethical according to guidelines from the American Counseling Association, and she was put on probation and warned she could be expelled.

She was asked in May 2010 to agree to a remediation plan that would require her to attend sensitivity training, read counseling journals and mix with gays at events like the city’s gay pride parade.

Keeton refused to comply with the plan, which she said in court papers would require her to “tell clients wanting to hear it that homosexual sex is moral.”

She filed a federal lawsuit claiming the school wanted to expel her because she “holds Christian ethical convictions” on human sexuality and gender identity. A judge rejected her challenge, leading to Tuesday’s court arguments.

Attorneys for both sides declined comment after the hearing because the case is under a gag order by the court.

The case has drawn national attention from religious groups and gay rights advocates.

Keeton’s lawsuit was brought by the Alliance Defense Fund, a Christian advocacy group that that presses faith-based cases in court nationwide. It argues that the First Amendment protects Keeton’s rights to share her beliefs about gays with others.

The American Civil Liberties Union and Lambda Legal, the national gay rights law firm, took the opposing side. They argued that counselors shouldn’t discriminate based on sexual orientation and should avoid imposing their values on clients.

Small Business Saturday boosts Nob Hill

ALBUQUERQUE (KRQE) – Nob Hill had shoppers everywhere. Store owners say it was more than usual for this time of year.

“This is a jigsaw puzzle for my husband, i hope he doesn’t see this tonight,” said Karen Nesbit, a shopper. Nesbit and her friend, Jane Miller were taking Nob Hill by storm.

“Look at what i got for my granddaughter,” said Miller about the Christmas presents she bought for her family.

They’re getting all of their holiday shopping done on Small Business Saturday. It is part of a national movement endorsed by President Obama, and New Mexico Governor Susana Martinez to encourage shopping at small businesses, like Revolver Vintage on Central Avenue.

“Friday’s all big box stores and it’s all the malls are really busy. The heart of america is mom and pop businesses,” said Anastasiou.

And the mom and pop shops were hopping. Nob Hill was packed today with shoppers clutching bags traveling store to store.

“Lunch at Flying Star, that’s local, we didn’t go in any place that was commercial,” said the shopping friends.

With all of the Christmas cash going to locally owned businesses, that means holiday dollars to keep businesses like Revolver Vintage alive, with more of a chance of surviving the recession.

“They’re buying, they’re shopping, it’s pretty awesome. I just hope the trend continues through Christmas,” said Anastasiou.

Small Business Saturday was created last year by American Express. The company gave 25 dollar credits to shoppers who shopped at small businesses.

The City of Albuquerque is allowing free parking in Nob Hill, Downtown, and Old Town to make it easier for shoppers to visit locally-owned businesses.

The free parking ends December 27th.

CHC chair Gonzalez to retire (Politico)

Texas Rep. Charlie Gonzalez, chairman of the Congressional Hispanic Caucus, will forego reelection in 2012, he announced Friday.

“I still find the job hugely rewarding, but the demands pull me somewhere else,” Gonzalez told the San Antonio Express-News on Friday. “I’ve been in Congress for 14 years and I want to do something else ? what that is I really don’t know. But financially I would like to be productive and have the resources to make a better life.”

Gonzalez, a seven-term Democrat, is slated to hold a Saturday press conference in San Antonio to discuss his decision, according to his office.

Gonzalez becomes the 17th House Democrat to announce he will not seek reelection. Seven House Republicans will not seek another term in 2012.

His exit marks the end of an era: a Gonzalez family member has held a seat in the House for more than five decades, and the Gonzalez name is a staple in the San Antonio political world. In 1999, Gonzalez, a former district court judge, succeeded his father, former Rep. Henry Gonzalez, who began his congressional tenure in 1961.

Democrats familiar with Gonzalez’s decision say they expect the retirement will have an electoral ripple effect. State Rep. Joaquin Castro will likely run for the seat and former Rep. Ciro Rodriguez is expected to run for a nearby district. The filing period for candidates to declare their intentions to run for Congress in Texas opens on Monday.

Gonzalez’s decision comes amid high tensions surrounding the state’s redistricting process. On Wednesday, a San Antonio-based federal court released a proposed interim congressional map that would position Democrats to gain as many as three seats in the state. The court was tasked with drawing an interim congressional map while a Republican-drawn plan, approved by the state Legislature earlier this year, is in limbo in a Washington, D.C. court over whether it dilutes minority voting strength.

Republicans have complained bitterly about the proposed map, alleging it favors Democrats. On Friday, the San Antonio court denied a request from state Attorney General Greg Abbott, a Republican, to stay the interim plan. Abbott immediately announced that he would appeal the decision to the U.S. Supreme Court.

Under the court’s proposed map, Gonzalez would have been able to run for an eighth term in a San Antonio-area district that strongly favored a Democrat.

His decision might come as a surprise to some. Gonzalez raised more than $136,000 in the third quarter ? a decent sum that does not typically indicate an impending retirement.

India opens door to foreign supermarket chains (Reuters)

NEW DELHI (Reuters) ? India threw open its $450 billion retail market to global supermarket giants on Thursday, approving its biggest reform in years that may boost sorely needed investment in Asia’s third-largest economy.

The world’s largest retail group, Wal-Mart Stores Inc (WMT.N), and its rivals see India’s retail sector as one of the last frontier markets, where a burgeoning middle-class still shops at local, family-owned merchants.

Allowing foreign retailers to take stakes of up to 51 percent in supermarkets would attract much-needed capital from abroad and ultimately help unclog supply bottlenecks that have kept inflation stubbornly close to a double-digit clip.

“I think it will have a very deep and long-lasting impact on the Indian landscape,” Raj Jain, CEO of Wal-Mart India, told CNBC TV18. “I think it will redefine the way consumers shop in India, but more importantly the way supply chains in India run.”

Under fire for a slow pace of reform, Prime Minister Manmohan Singh’s embattled government appears to be slowly shaking off a string of corruption scandals to focus on policy changes long desired by investors.

“This is a very bold move and the economic reforms process is back on track.” Rajan Mittal, vice chairman of India’s Bharti Enterprises, which is Wal-Mart’s partner, told reporters.

Millions of small retail traders vigorously oppose competing with foreign giants, potentially providing a lightning rod for criticism of the ruling Congress party ahead of crucial state elections next year.

Food Minister K.V. Thomas said the government will allow foreign direct investment of up to 51 percent in multi-brand retail – as supermarkets are known in India. It will also raise the cap on foreign investment in single-brand retailing to 100 percent from 51 percent, he added.

The new rules may commit supermarkets to strict local sourcing requirements and minimum investment levels aimed at protecting jobs, according to local media.

A heavyweight member of Singh’s coalition government warned on Thursday it totally opposed opening the sector.

The move is politically risky. Fears of potential job losses could heighten popular anger at the Congress party ahead of key state polls next year that will set the stage for the 2014 general election.

But slowing growth and investment in India, with the rupee currency around historical lows and government finances worsening, may have spurred the government into action.

“Manmohan Singh, after all the scams and the impression of government paralysis, has realized it’s time to take some bold steps. This is a very bold step that will please the middle class,” said political analyst Amulya Ganguli.

POLITICAL OPPOSITION

India previously allowed 51 percent foreign investment in single-brand retailers and 100 percent for wholesale operations, a policy Wal-Mart and rival Carrefour, among others, had long lobbied to free up further.

“For international retailers, it will open up a $1.6 trillion market growing at 8-9 percent so it’s a big business opportunity for all of them,” said Thomas Varghese, CEO of Aditya Birla Retail, an Indian supermarket chain.

Indian retailers have operated supermarket chains in India for years, but their expansion has been hampered by a lack of funding and expertise as well as poor infrastructure which makes the cold storage of food transported around the country practically impossible.

Political opponents of the proposal, with an eye to the ballot box, argue an influx of foreign players – which could include Carrefour (CARR.PA) and Tesco Plc (TSCO.L) – will throw millions of small traders out of work in a sector that is the largest source of employment in India after agriculture.

India’s biggest listed company, Reliance Industries (RELI.NS), was forced to backtrack on plans in 2007 to open Western-style supermarkets in the state of Uttar Pradesh after huge protests from small traders and political parties.

The main opposition Bharatiya Janata Party (BJP) opposes opening up the retail sector, arguing that letting in “foreign players with deep pockets” would bring job losses in both the manufacturing and service sectors.

“Fragmented markets give larger options to the consumers. Consolidated markets make the consumer captive,” the BJP’s leaders of the upper and lower houses of parliament said in a statement before the decision. “International retail does not create additional markets, it merely displaces (the) existing market.”

Occupy Wall Street plans benefit album for itself (AP)

NEW YORK ? Occupy Wall Street has a benefit album planned with Jackson Browne, Third Eye Blind, Crosby & Nash, Devo, Lucinda Williams and even some of those drummers who kept an incessant beat at Manhattan’s Zuccotti Park.

Participants in the protest movement said Wednesday that “Occupy This Album,” which will be available sometime this winter, will also feature DJ Logic, Ladytron, Warren Haynes, Toots and the Maytals, Mike Limbaud, Aeroplane Pageant, Yo La Tengo and others.

Activist filmmaker Michael Moore is also planning to sing.

Jason Samel, a musician who is putting together the disc, said the goal is to raise between $1 million and $2 million to help fuel the movement that is protesting income disparity.

“It’s really going to be an amazing help for years to come,” Samel said.

Money raised will go through the nonprofit Alliance for Global Justice. The initial plan is that half of the proceeds will go to the New York movement that was based in Zuccotti Park until being kicked out last week, and the other half to offshoots across the world who apply for specific projects, he said.

There’s a long history of benefit albums, from George Harrison’s “Concert for Bangla Desh” that raised millions for flood victims through Unicef in 1971, and the “We Are the World” single in the 1980s, which raised more than $60 million for famine relief in Africa.

Amnesty International also announced Wednesday that it will put on sale in January a 75-song set of Bob Dylan covers by various artists to benefit the human rights organization.

The Occupy Wall Street album will be available in digital form first, with plans for a physical CD still unclear.

The music will generally be a mixture of live cuts and new songs. Third Eye Blind, for example, has already posted its song, called “If There Ever Was a Time,” which specifically addresses the protest movement.

Haynes has offered a live version of “Rivers Gonna Rise,” a song from his last disc.

Some little-known artists who have participated in the protest will also be included, such as Kaneska Carter and Matt Pless, who wrote “Something’s Got to Give.”

“The lyrics convey a universal feeling of compassion and a hope for a better existence that I believe are the common threads that wind through everyone,” Pless said. “The positive spirit behind this song is a reflection of what birthed the movement and still exists at its core.”

One song will feature the loosely-formed group of people that would beat on drums at the entrance to Zuccotti Park, much to the consternation of neighbors and even some demonstrators as they tried to get some sleep.

Musicians like Tom Morello, David Crosby and Graham Nash had impromptu concerts for some of the demonstrators.
